Orders & Delivery
Order
Full payment is required for orders available for delivery or pickup within 4 weeks. A deposit of 50% is required for orders with a lead time exceeding 4 weeks. Once an order is submitted, you have a 24-hour period to cancel it. After this period, your order can only be canceled if it has not been shipped from its original stock location. In this case, any payment made will be converted to a store credit, which cannot be refunded. If your order has already been shipped from its original stock location, it cannot be canceled.
Your order must be paid in full at least one day prior to delivery. Cheques must also be cleared before the day of delivery. Please note that our delivery team cannot accept payments during delivery. If the balance is not cleared, your delivery will be automatically canceled.
Your order may have slight color variations compared to what was viewed on the website or catalog. It is the customer's sole responsibility to ensure that your order is the correct size for your intended space. Your order cannot be returned or refunded due to these factors.
Delivery lead times are estimates. While we strive to deliver your order within the stated timeframe, unforeseen circumstances such as backorders may still cause delays. We will notify you within one week if your order is affected by backorder status. Estimated arrival dates for backorders may change, and we will provide updates as we receive more information. Herchi Furniture is not responsible for any loss, damage, or costs arising from order delays.
Once you have received your order, it cannot be returned or refunded due to buyer’s remorse.
If the customer is unable to take delivery within 30 days of being notified that the items are ready, storage charges may apply unless otherwise communicated with your sales representative. If the customer is unreachable by phone or email or is unable to take delivery after 30 days of notification, the non-refundable deposit will be forfeited, and Herchi Furniture reserves full discretion on how the order’s items will be handled.
While we make every effort to fulfill all orders, Herchi cannot guarantee the availability of any particular product displayed on this site. Herchi reserves the right to discontinue the sale of any product listed on this site at any time without notice. Prices, delivery rates, and other information are accurate to the best of our knowledge, but are subject to applicable taxes and change without notice. Additionally, we reserve the right to correct any errors, inaccuracies, or omissions, including after an order has been submitted and accepted.
Custom Order
A deposit of 50% is required for custom orders. Once an order is submitted, you have a 24-hour period to cancel it. After this period, your custom order cannot be canceled unless it cannot be fulfilled due to production issues. Custom orders cannot be guaranteed for modifications once submitted. Charges may apply for any approved production modifications.

Colors of certain materials may differ slightly from our floor models or swatches due to dye lot differences. This difference is usually minimal but can be noticeable when compared to previous orders. Custom sizes may have a margin of error of 1-3 inches. It is the customer's sole responsibility to ensure that your order is the correct size for your intended space. Custom orders cannot be returned or refunded due to these factors.
Production and delivery lead times are estimates. While we make every effort to ensure your order is delivered within the stated timeframe, unforeseen circumstances such as port strikes, Canadian customs inspections, and shipping reroutes may still cause delays. Orders cannot be canceled, returned, or refunded due to delays. Herchi Furniture is not responsible for any loss, damage, or costs arising from order delays.
Once you have received your order, it cannot be returned or refunded due to buyer’s remorse.

Shipping
At Herchi Furniture, we are dedicated to providing excellent service and flexibility for every purchase. Our delivery service ensures the safe transportation of your items while prioritizing your satisfaction. We work to deliver your order as quickly as possible on a day that fits your schedule. For your convenience, all items in an order are shipped together, and we provide an estimated delivery timeline at the time of purchase. Once your shipment arrives at the local terminal, we will contact you to schedule delivery to your home within a designated four-hour window. Please ensure someone is available during the scheduled 4-hour delivery window. Missed deliveries will incur an additional fee for rescheduling.
Please ensure your delivery environment is safe for both our employees and your products. This includes salting driveways and stairs, and removing snow during winter, restraining pets during white-glove delivery, and clearing the designated area for the placement of your new furniture. If our truck cannot be parked near your front door due to excessive snow or ice, delivery will be rescheduled, and an additional fee may apply. We thank you in advance for your cooperation in helping us provide a smooth and efficient delivery experience.
If you have chosen to pick up your order, please wait for a confirmation call from us before coming to collect your items. While the majority of our orders arrive within the expected timeframes, unforeseen variables during transit may affect delivery schedules. As such, Herchi Furniture is not responsible for any loss, damage, or costs arising from shipping or delivery delays.
Standard Delivery
Our Standard Shipping service begins at $120 + HST for the first 50 kilometers. This service includes basic delivery to your front door but does not cover inside delivery, assembly, or packaging removal. A signature is required upon delivery, and transit times are typically 2–3 weeks, subject to stock availability.
White Glove Delivery
For an elevated experience, our White Glove Shipping includes delivery, inside placement (up to one flight of stairs), assembly, and the removal of large packaging materials. This service starts at $220 + HST but excludes installation of wall mounts or light fixtures and moving existing furniture. Additional services may be quoted upon request. Delivery times for White Glove shipments are estimated at 2–3 weeks but may vary based on stock availability.
Customer Pick-Up Guidelines
We offer a free pick-up option from both our Barrie and Newmarket showrooms. You will be notified directly as soon as your order has been prepared. Orders can only be held for pick-up for 15 calendar days. If you require additional time, please inform your sales associate at the time of purchase. Storage fees may apply if prior notification is not provided. If a third party is collecting your order please notify us in advance and ensure that they bring a photo ID or our team may deny pick up. Please ensure you notify us at least 48 hours in advance of your pick-up, especially for larger items.
We recommend bringing a larger vehicle and a friend to help carry the order, as our team may not be able to assist with loading. Herchi Furniture is not liable for any loss, shipping damage, cost, or expense once the warehouse transfers possession of the order to the customer or the customer's appointed party.
Returns & Cancellations
Returns
All sales are final once delivered or picked up.
Damaged or Defective Items
We stand behind the quality of products we sell. While cases are rare, damages and defects do happen once in a while.
Inspect item upon delivery. You will have a (2) day claim window for issues that are visible. If you need to store your items for an extended period of time, such as during construction or renovation, please be sure to inspect the product before moving them into storage as the (2) day claims window will still apply.
If damage is noted during delivery, notify our delivery team or your sales person immediately. Take pictures or videos to show the area of problem. Email them to info@herchi.ca with your order number and description of the problem. You can also complete the contact form via our 'Contact Us' page, making sure to include your order number, a description of the issue, and pictures or video of the product.
Claims received in excess of (2) calendar days beyond the delivery or pickup will not be accepted if the issue is a visible damage such as damage on leather, fabric or wood surface.
Photographs must be clear and attached to your claim within (2) calendar days
We will send a replacement part via Standard Shipping, offer a blemish discount, or offer local repair reimbursement at our discretion. In the event of a replacement, items with structural damage and/or determined unusable will be fully replaced where possible; items with aesthetic blemishes will be subject to repair or part replacement where possible.
Our furniture is for indoor use only, unless explicitly specified, and as such will not cover the costs for damaged or defective items in the event that the furniture was made damaged or defective as a result of customer negligence.
All items marked as Final Sale are non-refundable and cannot be exchanged for other items as they are sold in the condition as is. Final Sale items are exempt from regular store policy and are only covered by Herchi Limited Warranty for 90 calendar days. Strictly no exceptions will be made for Final Sale items.
Refund
Refunds can only be issued via the method of the original purchase. If the original method of payment is no longer available, we will issue store credit equal to the amount of the refund. It may take up to 10 business days for a refund to appear. If a refund does not appear in the customer’s bank account after 10 business days, the customer is encouraged to contact your card issuer directly with information from your card refund receipt. Herchi Furniture cannot be held responsible for third party costs. Shipping charges, membership fee, custom and special order furniture are non-refundable. Standard Shipping and White Glove Delivery Service charges are not refundable. We do not accept any returns or exchanges on custom and special order furniture.
All items marked as Final Sale are non-refundable and cannot be exchanged for other items as they are sold in the condition as is. Final Sale items are exempt from regular store policy and are only covered by Rove Limited Warranty for 90 calendar days. Strictly no exceptions will be made for Final Sale items.

What Does this Warranty Cover?
This warranty covers manufacturing defects.
How Long Does The Coverage Last?
This warranty begins on the date of delivery or pickup. Unless otherwise specified for products with extended coverage, the warranty covers one year for any soft parts, workmanship-related failures, and the associated labor. Examples of issues covered under the 1-year warranty include threading, piping, buttons, rubber components, adhesive parts, mechanical parts, and electronic components that fail or come loose under residential, non-commercial use.
For the second year following delivery or pickup, the warranty covers replacement parts (if available) needed for approved repairs; however, labor costs are not included. If repair services are required during the second year, a local repair company will provide a quote for the necessary work, subject to customer approval.
What Will Herchi Do?
For issues under the warranty, Herchi Furniture will provide replacement part(s) at no charge with a lead time of up to 24 weeks. For the 1 year warranty on soft parts and workmanship related failures, including threading, piping, buttons, rubber components, parts with glue as adhesive, mechanical parts, and electronic components, Herchi will reimburse local repair charges under the conditions that 1) The repair service quote is first approved by Herchi Furniture and 2) Herchi Furniture does not guarantee the work performed by the local repair service, and cannot be held to further compensation in the event of dissatisfactory repair work.
What Does This Warranty Not Cover?
This warranty does not cover marble, paint, leather, metal finish, fabric, fiberglass, foams, plywood, rugs, veneers, cushioning, glass, and coating materials. Any problem that is caused by other abuse, misuse or an act of nature (such as wind, flood, freezing water – including splitting and breakage from water accumulation in tubing), animal damage, burn marks (including those resulting from sunlight passing through glass filled with liquid which can at certain times act as a magnifying lens), fading, staining and mildewing of fabrics, compression of cushion fillings/fiber, and failure to take reasonable care of the furniture including proper care and maintenance is neither covered. Consequential and incidental damages are not recoverable under this warranty. Coverage terminates if you sell or otherwise transfer the furniture.
All items marked as Final Sale are non-refundable and cannot be exchanged for other items as they are sold in the condition as is. Final Sale items are exempt from regular store policy and are only covered by Rove Limited Warranty for 90 calendar days. Strictly no exceptions will be made for Final Sale items.
Electrical component failures for lighting are covered by Herchi Limited Warranty for 90 calendar days.
How Do You Get Service?
To start a claim, email pictures/videos to info@herchi.ca with your order number and description of the problem. Let your sales representative know so he/she can also follow up on the process for you. You can also complete the contact form via our 'Contact Us' page, making sure to include your order number, a description of the issue, and pictures or video of the product.
Changes to Terms and Conditions and to Site. Rove reserves the right to modify or change the terms of use of this site with or without notification.
Herchi Members Program
Members Program Benefits & Exclusions
The Members Program is a paid membership program that is subject to these Terms and Conditions and applicable law, provides members of the Members Program with the following online benefits:
- 30% savings on applicable full-priced items for an entire year
- Additional 15% savings on applicable sale items
- 10% back in voucher
- 5% back in voucher on applicable clearance & floor model items
- Complimentary design consultation
- Dedicated concierge order service
- VIP access to sales events
Membership is non-transferable. Voucher caps at $500 per order. Complimentary design consultation includes client home visits and design appointments in the showrooms. For delivery distance within 50km, delivery is complementary; for delivery distance over 50km, $120 will be deducted from the total before any applicable taxes. Complimentary delivery applies to one address only. Complimentary delivery only includes delivery to the doorstep and does not include installation (set-up).
Benefit Exclusions
Members Program benefits do not apply to purchases made on website, social media platforms or special sale events.
The Members Program benefits cannot be used in conjunction with any Trade discounts and are not stackable with other coupons unless specifically stated otherwise in the applicable coupon or discount.
Members Program discounts cannot be used towards the purchase of furniture service plan, financing service fee, shipping and installation or toward applicable taxes.
Members Program discounts cannot be used towards floor model sale, clearance sale, special sale, and price match.
Vouchers are limited strictly to one per order. Promotional exceptions may apply. Vouchers are calculated from the order subtotal before shipping and applicable taxes and after discounts. Your original order number will be your voucher number. Vouchers will be active after delivery or pick up. Vouchers are not store credit and any amount not used in a voucher will be forfeited. Membership fee is not refundable. Orders with vouchers applied cannot generate new vouchers.
Terms and Conditions
Terms and conditions set forth below ("Terms and Conditions") apply to the Herchi Members Program ("Members Program"). These Terms and Conditions are between you ("Member" or "you") and Herchi Furniture. ("Herchi", "we" or "us"). By registering, joining or using the Members Program, you hereby consent to enter into an electronic agreement and for Herchi Furniture to send you electronic communications about your Members Program ("Membership"), as further set forth below, and you hereby agree to these Terms and Conditions and the Herchi Privacy Policy.
For information on the Herchi Privacy Policy, please review the Herchi Privacy Policy, as it may be amended by us from time to time.
Consent to Electronic Communications
By registering, joining or using the Members Program, you are consenting for Herchi to send you electronic communications about the Members Program and your Membership.
You consent to receive communications relating to your Membership in electronic form. The communications covered by your consent may include, but are not limited to: (i) any initial disclosure statement or agreement governing your Membership, including these Terms and Conditions; (ii) any disclosure required by provincial, territorial or local law; (iii) any letter, notice or alert regarding your Membership, including, but not limited to, notices regarding expiration and renewal of your Membership, and any change to your Membership; and (iv) any other disclosures, notices or communications in connection with the application for opening of, and maintenance of your Membership. Such electronic communications may include your name and certain information about your Membership, including the expiration date of your Membership and Membership renewal fee. Electronic communications may be reviewed by any party, including us, with access to your Membership, the email account you have provided to us for delivering these communications, or the hardware or software you use to view your Membership information or your email account.
To withdraw your consent, you may not apply online for a Membership, and you may not register your Membership for online services (including electronic statements or mobile alerts), unless you also provide your consent to receive electronic communications. If you have registered for online services (such as electronic statements or mobile alerts) and you subsequently wish to withdraw your consent to receive future electronic communications, you must unsubscribe from each service you have elected to receive in order to completely withdraw your consent to receive electronic communications. Any withdrawal of your consent to electronic communications will be effective only after we have a reasonable period of time to process such withdrawal request.
You agree to promptly update your contact information, including your email address, if it changes, by providing such updated information through your online account with us (at herchi.ca) or by calling Herchi Furniture.
In order to access your Membership and any related electronic communications, you must have a computer, mobile device or other device with Internet-browsing capabilities; an SSL-enabled web browser that supports HTML 5, JavaScript and CSS3; an Internet connection; and sufficient electronic storage capacity on your hard drive or other data storage facility, or a means to print or store notices and information through your browser software. We will update on our website offering the Members Program, any changes in such requirements that may affect your access to electronic communications related to your Membership. You should periodically check for such posted information.
All communications in either electronic format from us to you will be considered to be in writing.
You acknowledge that by clicking on the "Join Now", "Sign In to Join", "Continue", “Apply Now” or a similar button provided in connection with these Terms and Conditions, you are consenting to electronic communications, and such action shall constitute your signature.
You acknowledge and agree that your consent is being provided in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act, and that you and we both intend that the Act apply to the fullest extent possible to validate our ability to conduct business and communicate with you by electronic means.
When you place an order with Herchi Furniture/Herchi Members Program, we'll transfer your name and address to your credit card company for confirmation to complete your purchase, and then to our fulfillment center to deliver your order. We promise to never use your name and address for any other purpose, including selling it to mailing-list firms. Sometimes we do share blanket information and statistics about our customers with important business partners, but we’ll never reveal your individual details. We will only share your personal information when required by law.
You must be at least eighteen (18) years of age or older, or at least nineteen (19) years of age or older in certain provinces of Canada to sign up Herchi Members Program. If you are under 18, you may use herchi.ca only with involvement of a parent or guardian. You agree to accept responsibility for all activities that occur under your account or password. Roveconcepts.com reserves the right to refuse service, terminate accounts, remove or edit content and cancel orders at its sole discretion.
Members Program Fee, Term and Renewals
The fee for the members program (the “membership fee” is three hundred and ninety-nine dollars ($399.00) per year, plus any applicable taxes, and is non-transferable. Herchi Furniture Inc. may, in its sole and absolute discretion, change the membership fee from year to year. Herchi Furniture may cancel and or terminate the Herchi Members Program at any point as per Herchi’s discretion. If the Herchi Members Program is cancelled/terminated by Herchi Furniture Inc. at any point members will be refunded for the remaining time left in the membership. Except as expressly set forth in these terms and conditions or otherwise required by applicable law, paid membership fees are non-refundable. If you decide to cancel your membership, your membership will automatically expire at the end of your then-current membership term.
You may join the members program in store, through herchi.ca or by emailing info@herchi.ca.
For members program benefits to apply to a particular purchase, your membership must be active and available at the time of purchase. You may provide Herchi Furniture with your name, email address and or phone number to verify your membership, so that you receive your applicable members program benefits. Your membership will become active at the time of joining the members program and its benefits may be applied immediately to any purchase made after you become a member. You will not receive any retroactive benefits for purchases made after your membership is terminated unless you re-enroll.
Enrollment and participation in the members program are voluntary, optional and not required to complete any transaction or sale, including, but not limited to, any credit transactions.
Herchi Furniture Inc. reserves the right, in its sole and absolute discretion, to exclude any individual(s) from the members program or to terminate any membership, for any reason, including, without limitation, abuse of the members program, failure to follow these terms and conditions, or fraud, misrepresentation or other conduct detrimental to the interests of Herchi Furniture Inc. Any such exclusion or termination may affect eligibility for further participation in the members program.
The members program makes available special discounts, savings and/or complimentary access (as applicable) with respect to certain goods and services, as expressly provided in these terms and conditions. Notwithstanding anything herein to the contrary, no services are made available pursuant to these terms and conditions; and services made available by Herchi Furniture Inc. are made available subject to separate terms, and certain goods may be subject to separate terms as well.
Changes to Members Program and these Terms and Conditions
Herchi Furniture Inc. may, in its sole and absolute discretion, change any provision of these Terms and Conditions, including, without limitation, Members Program benefits, exclusions and fees, at any time and without any liability. Herchi Furniture Inc. may notify you of such changes by any reasonable means; including by posting revised Terms and Conditions on our websites offering the Members Program. Any change to these Terms and Conditions shall take effect immediately, unless otherwise provided by Herchi Furniture Inc. or otherwise required or prohibited by law. You may view the current version of the Terms and Conditions at any time at Herchi.ca.
To the extent required by applicable law in Canada, we will notify you of changes to the Terms and Conditions, and such notice will be sent to you at least thirty (30) days before the changes come into force, and will set out the new clause only (or the amended clause and the clause as it read formerly). If you do not agree to the changes to the Terms and Conditions set forth in the applicable notice, you may stop using your Members Program benefits and cancel your membership without cost, penalty or cancellation indemnity.
You may also obtain a copy of the current Terms and Conditions by emailing info@herchi.ca. It is your responsibility to check or review the Terms and Conditions from time to time to keep informed of changes.
To the fullest extent permitted by applicable law, if you continue to use your Membership after we change these Terms and Conditions, or if you do not cancel your Membership as described above, you will be indicating your acceptance of such changes. If any changes to these Terms and Conditions is for any reason found invalid, void or unenforceable, such change is severable and will not affect the validity and enforceability of any remaining change or any other provision of these Terms and Conditions.
Accuracy of Information
We expect Members to submit and maintain accurate and current information in connection with their Membership. Such information includes, without limitation, name, address, email address and phone number. Members are responsible for ensuring that all of their account information is up-to-date and accurate (as account information such as, without limitation, a Member’s billing address may affect certain Membership renewal terms and legally mandated notice requirements). Members can change their Membership information by; updating their member profile data or by emailing info@herchi.ca. We are not responsible or liable for any correspondence (including any physical mail or email) that is lost, delayed or misdirected.
Marketing & Email Communication
Unless you expressly opt-out, by joining the Members Program. You, to the extent permitted by applicable law, automatically subscribe to Herchi Furniture Inc.’s marketing and email exclusives and will receive, and agree to receive promotional emails from Herchi Furniture Inc. Unsubscribing from Herchi Furniture Inc.’s marketing and/or email exclusives will not discontinue your Membership. If you do not wish to receive future marketing and/or
email exclusives, you can request that they be discontinued via email (info@herchi.ca) and/or by calling Herchi Furniture. We will seek to implement your request within a reasonable time period. Please note that Members who unsubscribe from marketing and/or email exclusives will continue to receive non-marketing emails and other communications from Herchi Furniture Inc. relating to the Members Program.
Disclaimers: Limitation of Liability
To the fullest extent permitted under applicable law: (A) Use of the Members Program and any of its associated benefits is at your sole risk; (B) the Members Program and its benefits are provided on an “as is” and “as available” basis; (C) Herchi Furniture Inc. and all of its directors, officers and agents (collectively, “Members Program Providers”) expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement; and (D) Members Program Providers make no warranty that: (I) the Members Program will meet your requirements; (II) the Members Program will be uninterrupted, timely, secure or error-free; or (III) the quality of any products, services, information or other material purchased or obtained by you in connection with your use of the Members Program will meet your expectations.
To the fullest extent permitted under applicable law; (E) Members Program Providers will not be liable for any indirect damages of any kind arising our of or in connection with your application for membership in, your participation in, your membership in and/or the termination of your membership in, the Members Program; and (Z) the foregoing is a comprehensive limitation of liability that applies to all damages of any kind, including but not limited to, indirect, incidental, punitive and/or consequential damages, loss, misappropriation and/or theft of data, goodwill, income or profit, loss of or damage to property of any kind, any other tangible losses and claims of third parties resulting from: (I) the use or the inability to use the Members Program or any benefits thereof; (II) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into in connection with the Members Program; (III) unauthorized access to or alternation of your Members Program data; or (IV) any other matter relating to the Members Program or your membership.
To the fullest extent permitted under applicable law: the maximum collective liability of the Members Program Providers for all damages, losses and causes of action. However arising, shall be equal to the greater of (1) the membership fees actually paid by you to the Members Program Providers in exchange solely for the right to use the Members Program in the previous twelve (12) months; and (2) three hundred and ninety-nine dollars ($399.00) + applicable taxes. Except as may be prohibited by applicable law, the limitations set forth herein shall apply with respect to any theory of legal liability, including breach or repudiation of contract tort, civil liability, negligence, gross negligence, strict liability or otherwise, even if advised of the possibility of such damage.
To the fullest extent permitted under applicable law, by agreeing to these Terms and Conditions, you willingly agree that you have relinquished your right to seek damages from the Members Program Providers as set forth herein, and that such limitation reflects a reasonable allocation of risk.
Some jurisdictions (and the laws of certain jurisdictions) including the Quebec Consumer Protection Act, do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental, consequential or other damages; accordingly, some of the above limitations and exclusions may not apply to you.
Acknowledgement
These Terms and Conditions, including all documents referenced herein, represents the entire understanding between you and Herchi Furniture Inc. with respect to the Members Program, and supersede any other agreements, statements or representations with respect to the Members Program. Headings used in these Terms and Conditions are for reference only, and shall not affect the meaning of any terms. Any Member of the Members Program is deemed to have accepted these Terms and Conditions and the Herchi Furniture Inc. privacy policy.
Intellectual Property
As between you and Herchi Furniture Inc., all Members Program materials, including all designs, texts, graphics, logos, button icons, images, videos, audio clips, software, and the compilation thereof (including the selection, arrangement and assembly thereof) is the exclusive property of Herchi Furniture Inc., and is protected by international copyright and other intellectual property laws. Unless otherwise indicated on a particular part of the Members Program materials for the sole purpose of using the Members Program materials for your personal, noncommercial use, subject to these Terms and Conditions. Complete 5 Year Comprehensive Furniture Protection Plan
SmartOne Plan
This Protection Plan (“Protection Plan”) is administered by Zucora Inc. (“us”, “our”, “we” or “Zucora”) and is effective for a period of up to five (5) years from the date of delivery (“Effective Date”), for the item(s) covered by this Protection Plan (“Covered Products”), for the benefit of the owner (“you”, “your” or “Owner”) of the Covered Products. The Protection Plan is an agreement between Zucora and you the Owner, and is subject to compliance with the provisions hereof and the exclusions set out below and represents the entire agreement between the parties. No representation, promise or condition not contained herein shall modify these terms. Coverage as listed below is available in part or full, depending on the Protection Plan you purchased as confirmed by your sales receipt.
OBLIGATIONS OF ZUCORA TO OWNER OF ITEMS COVERED BY THIS PROTECTION PLAN:
1.0 COVERAGE FOR UPHOLSTERED FURNITURE – In the event the Covered Product is fabric, full or top grain leather, leather-look, bi-cast leather, bonded leather, or vinyl furniture and the upholstery becomes accidentally stained or damaged from a specific incident by:
a) Common household foods and beverages;
b) Human and pet bodily fluids (not including perspiration);
c) Household food oil and grease;
d) Cosmetics or nail polish;
e) Pen ink or crayon;
f) Dye transfer (newsprint and denim only);
g) Rip, tear or cigarette burn;
e) Frame, springs, joints, or mechanisms;
Zucora agrees to provide the Plan Services outlined in Section 5.0 with respect to the stained or damaged area. Additional coverage as listed in Section 2.0 is provided for show wood of the upholstered furniture. For a list of what is not covered by the Plan Services, see Section 8.0.
2.0 COVERAGE FOR WOOD FURNITURE – In the event the Covered Product is finished wood furniture and becomes stained by common household foods and beverages, liquid marks or rings, heat marks, or from a specific incident becomes accidentally damaged by scratches which penetrate the finish, or warping, lifting or bubbling of veneers from foods and beverages, or any glass or mirror component that becomes chipped or broken from a specific incident, Zucora agrees to provide the Plan Services outlined in Section 5.0 with respect to the stained or damaged area. Additional coverage as listed in Section 1.0 is provided for upholstered seats and backs of wood dining chairs and benches.
3.0 COVERAGE FOR POWER MOTION COMPONENTS – In the event the Covered Product is a powered motion upholstered product, and the optional Power Motion Coverage was purchased simultaneously with this Protection Plan, and the Covered Product experiences a mechanical or electrical failure; we agree to provide the Plan Services outlined in Section 5.0 to restore the Covered Product to normal operating condition. The optional Power Motion Coverage includes failed motors, gear units/pistons, control modules, transformers (backup batteries excluded), switches, remotes, massage units, heat units and wiring connectors. This coverage is limited to manufacturing and material defects that appear under normal use and operation in accordance with the manufacturer’s guidelines. Plan coverage starts after the manufacturer’s warranty expires.
4.0 COVERAGE FOR AREA RUGS – In the event the Covered Product becomes accidentally stained by common household foods and beverages, or human and pet bodily fluids; Zucora agrees to provide the Plan Services outlined in Section 5.0 with respect to the stained area.
5.0 AVAILABLE PLAN SERVICES – The following Plan Services will be provided by Zucora for your Covered Product under this Protection Plan:
a) You may request free professional stain removal and/or repair advice by contacting us at 1.800.388.2640 during normal business hours or by submitting a request for service at service.zucora.com. We may request photos or images of the stained or damaged area to assist in assessing your request for service; and we may, at our discretion, deliver cleaning solution to you to assist with the stain removal;
b) If the accidental damage or stain persists, Zucora will arrange to have the Covered Product serviced at your location by a professional technician at no additional charge to you;
c) If the technician determines that stain removal or damage repair must be made away from your location, the Covered Product will be removed, cleaned or repaired and returned at no additional charge to you;
d) If the technician cannot remove the stain or repair the accidental damage, Zucora will replace the damaged portion subject to the availability of materials and/or replacement items;
e) If replacement items or materials are not available, or the accidental damage or mechanical or electrical failure to the Covered Product cannot be repaired, Zucora agrees to exchange the Covered Product with a similar item of comparable value to the original purchase price (excluding taxes and delivery). Replacement applies to the stained or damaged Covered Product only, and does not provide for replacement of multiple pieces or sets of furniture that may have been purchased at the same time as the Covered Product. Owner shall provide Zucora with an original sales receipt or proof of purchase for the original Covered Product prior to obtaining approval from Zucora to exchange the Covered Product. The original Covered Product must be returned to the retailer from which it was purchased. Zucora will issue to the Owner a Return Authorization to exchange the Covered Product. The exchange must be completed within thirty (30) days of issuance, otherwise the maximum liability is the amount paid by you for this Protection Plan;
f) Zucora is not responsible for variations in dye lot of any replacement items, materials or products;
g)With the replacement of any Covered Product, the obligations of Zucora under this Protection Plan for the replaced Covered Product will have been fulfilled and no further service will be provided.
6.0 REGISTRATION AND ELIGIBILITY – To be eligible for Plan Services, this Protection Plan requires registration with Zucora (The owner will register this Protection Plan). The Owner acknowledges, approves and permits the collection, use and disclosure and/or dissemination of information regarding the Owner and this Protection Plan to Zucora for the purposes of carrying out Zucora’s responsibilities under the Protection Plan. Protection Plans are not refundable and not renewable beyond the registered coverage period and are limited to the Covered Product’s original Owner.
7.0 TO OBTAIN ZUCORA PLAN SERVICES – Claims for Plan Services must be made to Zucora within 14 days of the occurrence of the accidental stain or accidental damage to the Covered Product under this Protection Plan. Claims will only be considered by Zucora, subject to the following:
a) Covered Products are delivered to the Owner soil free and without stains, flaws, tears, rips, scratches or any other damage;
b) Cleaning of stained area or repair of the Covered Product is performed only as directed by Zucora;
c) Owner shall provide Zucora with an original sales receipt or proof of purchase for the original Covered Product upon request.
8.0 PLAN EXCLUSIONS – Requests for plan services cannot be accepted by Zucora for any of the following:
a) Anything not specifically identified and included as covered by this Protection Plan;
b) Failure to comply with the manufacturer’s instructions for use, cleaning or maintaining the Covered Product;
c) Power Motion Component Coverage only: damage resulting from improper installation, moisture, liquid spills, lightning, power failures and/or power surges, or physical damage;
d) Abuse or misuse of the Covered Product;
e) Wear and tear caused by repeated use, scratches, scuffs, accumulated soiling, build-up of perspiration and body or hair oils, mold, mildew, fading or any color variation, or odors of any kind;
f) Motor oil and mechanical grease;
g) Natural markings or characteristics in leather that cause appearance variations;
h) Damage caused by animals (other than staining by pet bodily fluids);
i) Separating or stretching of the covering material, stress tear, seam separation, material flaws, fabric pulls, fabric pilling, or deterioration of any material components;
j) Cracking or peeling of any material;
k) Covered Products in transit, damaged during moving inside or outside the home, storage;
l) Paint, bleach, permanent dyes, corrosives, nail polish remover, acids, permanent inks, or gum;
m) Non-colourfast materials, or shagreen or faux shagreen materials;
n) Any X-Coded fabrics or products made of natural materials such as silk or virgin wool;
o) Any unfinished natural wood, ceramic, quartz, marble, nubuck leather, or similar materials;
p) Any Covered Product sold in an “as-is” condition;
q) Use of Covered Products in public areas, rental or commercial uses;
r) Damage covered by any manufacturer warranty, other protection/service plan or insurance program;
s) Acts of God, fraud, intentional acts, war or hostilities of any kind if arising from illegal activity.
9.0 NOTE TO OWNER: This Protection Plan is provided by Zucora Inc. All claims and/or inquiries must be submitted directly to Zucora. Retailer is not responsible for any claims or service obligations provided under this Protection Plan. The maximum coverage liability of this Protection Plan shall not exceed the original purchase price of the Covered Product(s). The Owner shall reasonably cooperate with Zucora in its efforts to provide the services under this Protection Plan. Any provision contained herein which is found to be contrary to any local law shall be deemed null and void; however, the remaining provisions shall continue in full force and effect. By registering, or authorizing the registration of this agreement with Zucora, the Owner agrees that the obligations provided in this agreement shall constitute the full and only remedies for any failure of the Zucora product or service to function as warranted. In no event shall the Owner have any other remedy at law or equity for any direct or indirect consequences of the failure of the Zucora product or service to perform.
